Welcome to Trnity Pickleball ("we," "our," or "us"). By accessing or using our website, including any content, functionality, and services offered on or through www.trnitypickleball.com (the "Site"), you agree to comply with and be bound by these Terms of Service ("ToS"). If you do not agree to these ToS, please do not use the Site.

It is our right to modify, amend, or substitute any portion of these ToS by publishing updates and/or alterations on our website. It is your duty to regularly review this page for revisions.

Continued use of or access to the website following the posting of any changes signifies your acceptance of those modifications.

Our e-commerce website is powered by Wix LTD, providing the essential platform for us to present our products and services to you.

Important Notice for Amateur Athletes. You are responsible for ensuring that your participation on the Platform does not affect your eligibility as an amateur athlete. Please check with your amateur athletic association for the rules that apply to you. Trinity Pickleball is not responsible or liable for your use of the Platform resulting in your ineligibility as an amateur athlete.

2. Store Terms

Eligibility to use the Platform requires the following:

If you are of legal age in your country/region or if you have consent from your parent or guardian
If you are in compliance with all relevant laws, regulations
If you recognize and consent that Trnity Pickleball, at its sole discretion and without prior notice or any further obligations to you, may temporarily suspend or permanently terminate and deny access to, or use of, the platform, both now and in the future.

You agree not to:

Modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works of, transfer, or sell any Content; use, frame or utilize framing techniques to enclose any of our trademark, logo or other proprietary information (including the images) without authorization from us
Collect or use any product listings or descriptions without authorization from us
Breach, attempt to breach, or otherwise bypass any security or authentication measures of the Platform, the server on which our Sites are stored, or any server, computer or database connected to our Platform;
transmit into or submit to the Platform any of the following: viruses, malware, malicious or destructive code, or any other routine, device, or other undisclosed feature (e.g., so-called time bomb, software lock, drop dead device, malicious logic, worm, Trojan horse, or trap, back door, or software routine) that either interferes with or otherwise harms or provides unauthorized access or causes unauthorized modifications to the Platform, including the systems or servers which host the Platform;
use any data mining, robots, or similar data gathering and extraction methods from the Platform;
access or attempt to access any systems or servers on which the Platform is hosted or modify or alter the Platform in any way, other than for your use of the Platform as expressly permitted in these Terms,
attack our Platform via a denial of service attack or distributed denial of service attack.
forge headers, create a false identity or otherwise manipulate identifiers in order to deceive others or disguise the origin of any Content or other information transmitted to or via the Platform;
Do not use automated technology to interact with the Platform.

Any unauthorized use of the Platform will terminate the permission or license granted by these Terms, will result in you being barred from using the Platform, and may violate applicable law, including but not limited to, copyright laws, trademark laws (including trade dress), and communications regulations and statutes.

Be Secure: If you are creating an account, you will be responsible for the following

Keep your username, password and other login credentials secure and do not allow anyone else to use your account.
Inform Trnity Pickleball immediately of any unauthorized use of your account.

You are responsible for anything that happens through your Trnity Pickleball account – with or without your permission. TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, TRNITY PICKLEBALL IS NOT RESPONSIBLE FOR ANY LOSS OR ACTIVITY THAT RESULTS FROM THE UNAUTHORIZED USE OF YOUR ACCOUNT.

3. Service Conditions

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

LICENSE TO USE COMMENTS, FEEDBACK AND IDEAS. You understand that any comments, feedback, or ideas you send us are provided on a non-confidential basis and you grant to Trnity Pickleball a perpetual, worldwide license to use all comments, feedback and ideas you may share with us, without notice, compensation or acknowledgement to you, for any purposes whatsoever, including, but not limited to, developing, manufacturing and marketing products and services and creating, modifying or improving products and services.

We take no responsibility and assume no liability for any comments posted by you or any third-party. We may monitor, edit or remove said content written.

4. Partners on the Platform

From time to time, Trinity Pickleball may link to or partner with third-party websites, social media platforms, mobile apps, and other products and services (“Third Parties”). You may be able to connect with these Third Parties through the Platform, but this does not mean Trnity Pickleball endorses, monitors or has any control over these Third Parties or their activities, which are subject to separate terms of use and privacy policies. You should carefully review any Third Party’s sites and terms of use and privacy policy. Trnity Pickleball is not responsible for the content, policies, or activities of Third Parties and you interact with Third Parties at your own risk.

5. Electronic Communications

By using the Platform, you agree to receive certain electronic communications from Trnity Pickleball, subject to applicable law.

You agree that any notice, agreement, disclosure or other communication that Trinity Pickleball sends you electronically will satisfy any legal communication requirements, including that such communications be in writing.

No Waivers, Severability

Our failure to insist upon or enforce strict performance of these Terms is not a waiver of any of these Terms or Trnity Pickleball’s rights. Users should always assume these Terms apply.

If any provision in these Terms is held invalid or unenforceable, the remainder of these Terms shall continue to be enforceable.

16. Termination

Trnity Pickleball may terminate or modify any Trnity Pickleball Platform, member program, product or service at any time without notice.

We may terminate or suspend your account, delete your profile or any of your User Content, and restrict your use of all or any part of the Platform at any time and for any reason, without any liability to us, subject to applicable law.

17. Entire Agreement

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
